C-CART TERMS OF USE AND PRIVACY POLICY

TERMS OF USE

      These Terms of Use set out the terms and conditions under which you may access and use the Canadian Caregiver Assessment and Resources Tool (C-CART) on a platform (the “Platform”), operated by Baycrest Centre for Geriatric Care (“Baycrest”).  By accessing and using the Platform, you are indicating that you accept these terms and conditions, and any other notices posted on the Platform.  
      
      1.  Linked Sites. Our Platform contains links to websites that are independently operated and are not affiliated with Baycrest. Your access and use of these third party websites, including your right to reproduce materials found on these websites, are governed by the terms of use and privacy policies of such websites.  Please carefully review the privacy policies and terms of use of the third party websites. The links are provided for your information only, and we assume no responsibility for their content.
      2.  Availability of Our Platform.  Our Platform may be interrupted, including for maintenance, upgrades, or network or equipment failures. We may discontinue some or all of our Platform, including certain features and the support for certain devices and platforms, at any time. We do not warrant that the Platform will be operational, error-free or secure, or will function without disruptions, delays or imperfections.
      3.  General Information is not Medical Advice.  The information provided on the Platform is for informational purposes only.  It is not professional medical advice, diagnosis, treatment or care, and it is not intended to be a substitute for any of these. Always seek the advice of your physician or other qualified health provider properly licensed to practice medicine or general healthcare in your jurisdiction if you have questions about the information contained in this Platform including any medical condition you believe may be relevant to you or to someone else.

BAYCREST is not responsible for or liable for any viruses or contamination of your computer system or delays, inaccuracies, errors or omissions arising from your use of the Platform.  TO THE EXTENT PERMITTED BY APPLICABLE LAW, THE PLATFORM IS PROVIDED ON AN “AS IS” BASIS AND “AS AVAILABLE” BASIS AND BAYCREST DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES AND CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
          IN NO EVENT WILL BAYCREST BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES THAT RESULT FROM OR IN CONNECTION WITH THE USE OF, OR THE INABILITY TO USE OR ACCESS, THE PLATFORM, EVEN IF BAYCREST HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. 
      6.  Governing Law and Jurisdiction.  These Terms of Use and the Platform and your access and use thereof, are governed by the laws of the Province of Ontario and the laws of Canada. Any related dispute is to be submitted to a court of competent jurisdiction in the judicial district of Toronto, Province of Ontario. This Platform provides caregivers with links to resources available in Canada only.   
      7.  Updates to our Terms of Use.  Baycrest reserves the right to modify, alter or otherwise update these Terms of Use at any time without prior notice to you. You agree to be bound by any modifications, alterations or updates (“Changes”) and agree that any subsequent use by you of the Platform following any such Changes shall constitute your acceptance of all such Changes. 
    

PRIVACY TERMS

      1.  Purpose of Privacy Terms. The purpose of these privacy terms is to describe how information about you or that could identify you (collectively, your “Personal Information”) is collected, used, shared and retained by Baycrest in connection with your use of the Platform.   By accessing, registering with or otherwise using any part of this Platform you agree that we may collect, use and share the very limited Personal Information described in section 3 below.  
      2.  C-CART Privacy Practices. With the exception of the section below called “Cookies”, we do not collect any Personal Information about you.  We ask for certain general information from you, in order to provide you with links to relevant resources. 
      3.  Cookies.  The Platform collects, receives and records information on our server logs from your browser including your browser actions and patterns, by using cookies.  A “cookie” means a small text file placed on your computer or device by our Platform when you visit certain parts of our Platform and/or when you use certain features of our Platform. We use Google Analytics cookies to collect information about the use of the Platform and the preferences of the users.  The cookies help us to understand and analyze how people use our Platform and enable us to improve the Platform.  We may also use aggregated and de-identified cookie data for presentations and publications about C-CART and the Platform.  You can set your browser to refuse all or some browser cookies.       4.  Security of Personal Information. Data collected is stored on Microsoft Azure, on servers in Canada.  Once you leave the Platform, or click on links on the Platform, you may be redirected to a third-party website or application, and will then governed by that party’s privacy policy and terms of use. We are not responsible for the privacy practices or terms of use of any third parties.  
      5.  Note to Users Outside Ontario, Canada.  BAYCREST is located and operated in Ontario, Canada.  All matters relating to access to, or use of, this Platform shall be governed by the laws of the Province of Ontario and the laws of Canada, without regard to conflict of laws principles.
